Terms of Service

These Terms govern your use of Evaluate!. By creating an account or using the app, you agree to them. Please read them carefully — they include a limitation of liability and an arbitration agreement.

What to know up front

1.Acceptance of These Terms

These Terms of Service ("Terms") are an agreement between you and Evaluate!, operated by The Officials Hub ("Evaluate!", "we", "us", or "our"). By accessing or using the Evaluate! app or website (the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, don't use the Service.

2.Eligibility & Accounts

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or guardian.

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Provide accurate information and keep it current.

3.The Service

Evaluate! lets basketball officials, evaluators, and others submit and view peer evaluations of officiating performance, including rubric scores, game notes, and ratings. We may add, change, or remove features at any time.

4.Your Content & Evaluations

"User Content" means anything you submit to the Service, including evaluations, ratings, scores, notes, comments, and photos.

5.Evaluations Are Opinions

Evaluations and ratings on Evaluate! reflect the subjective opinions and personal experiences of the individual users who submit them. They are not statements of fact by Evaluate!, and we do not endorse, adopt, verify, or guarantee the accuracy of any evaluation. Ratings are generated automatically from user-submitted evaluations and should be understood as the aggregated opinions of those users.

6.Our Role as a Platform

Evaluate! is an interactive computer service that hosts content created by its users. We are not the author, publisher, or speaker of User Content.

Consistent with Section 230 of the Communications Decency Act (47 U.S.C. § 230), Evaluate! is not responsible or liable for User Content submitted by others, and we are not treated as the publisher or speaker of that content. Any opinions expressed in evaluations are those of the user who submitted them, not of Evaluate!.

7.Acceptable Use

You agree not to submit content or use the Service in any way that:

Evaluations should describe officiating performance, not attack a person's character. We may remove content and suspend or terminate accounts that violate these rules.

8.Reporting & Disputing an Evaluation

If you are the subject of an evaluation you believe is false, abusive, or in violation of Section 7, you may report it to us at [email protected] with enough detail to identify the content and explain your concern.

We will review reports and may, at our discretion, remove or restrict content that violates these Terms. We are not obligated to remove content, and removal (or non-removal) is not an admission of liability and does not waive any protection available to us. We aim to act on legitimate reports in a reasonable timeframe.

9.Content Moderation

We may, but are not required to, monitor, review, edit, or remove User Content. We reserve the right to remove any content and to suspend or terminate any account at our discretion, with or without notice, including for violations of these Terms. Our decision to moderate some content does not create an obligation to moderate all content.

You agree to indemnify and hold harmless Evaluate!, The Officials Hub, and our officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or the rights of any third party.

13.Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Arbitration agreement

You and Evaluate! agree to resolve any dispute relating to these Terms or the Service through binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court. The arbitration will be conducted on an individual basis.

Class-action waiver

You and Evaluate! agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Opt-out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name and a statement that you wish to opt out.

14.Intellectual Property & Copyright

The Evaluate! name, logo, app, and original content (excluding User Content) are owned by us and protected by intellectual-property laws. If you believe content on the Service infringes your copyright, contact us at [email protected] with the details required under the DMCA, and we will respond appropriately.

15.Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at our discretion, including for violations of these Terms. Sections that by their nature should survive termination — including content licenses already granted, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

16.Changes to These Terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above, and material changes may also be communicated in the app. Your continued use of the Service after an update means you accept the revised Terms.
